Terms of Use of the Sacoddo Platform
Preamble:
Welcome to the Sacoddo online platform. By using the platform, you acknowledge your acceptance of the Terms of Use. If you do not agree with these Terms, you may not use our platform. The platform reserves the right to modify these Terms of Use at any time. Changes will take effect as soon as they are posted on the platform. If we modify these Terms, we will publish the updated Terms on the Sacoddo platform and update the "Last Updated" date at the top of the document. Please check these Terms of Use regularly to stay informed about any updates. If you continue to access or use the Sacoddo platform after changes are made, you will be deemed to have accepted the modified Terms.
A limited, revocable, and non-exclusive license is granted to users to access the Site and the content and services provided on it, in compliance with these Terms of Use. Any use of the Site that does not comply with these Terms of Use or is not explicitly authorized by us in writing is strictly prohibited.
1. About Sacoddo Services
1.1 The Sacoddo Platform is an online site that allows users with an account (the Members) and third parties or Members who offer services (the Hosts) to publish the services they provide (Host Services) on the Sacoddo Platform (Listings). It also enables direct communication and transactions with Members who wish to book these Host Services (Travelers). Host Services may include short-term rentals of accommodations for vacations or other purposes (Accommodations), single or multi-day activities in various categories, and access to unique events and venues (Activities).
1.2 The Sacoddo platform is in no way affiliated with travel services or other regulated activities. Sacoddo does not own, create, sell, resell, provide, control, manage, or offer any Listings or Services provided by Hosts. Sacoddo is also not a package travel organizer or retailer, and Hosts are solely responsible for their Listings and Host Services. When Members make or accept a booking, they enter into a direct contract with each other. Sacoddo is not and does not become a party to any contract between Members, nor is it a real estate broker or insurer. Sacoddo does not act as an agent for any Member, except as provided in the payment process.
1.3 The content published by users cannot, under any circumstances, be monitored by the platform. Each user assumes full responsibility for their publications and commitments.
1.4 While Sacoddo may facilitate dispute resolution, it does not control or guarantee (a) the existence, quality, safety, suitability, or legality of Listings or Host Services, (b) the accuracy or truthfulness of Listing descriptions, Ratings, Reviews, or other Member Content (as defined below), or (c) the performance or behavior of any Member or third party. Sacoddo does not endorse any Member, Listing, or Host Service. Any reference to a “verified” Member (or similar term) only means that the Member has undergone an appropriate verification or identification process and nothing more. Such a designation does not constitute an endorsement, certification, or guarantee by Sacoddo regarding a Member, including their identity, background, or reliability. You should always exercise caution when deciding to stay in an Accommodation, participate in an Experience or Event, use other Host Services, accept a Traveler's booking request, or engage in any other interaction with another Member, whether online or in person. Verified Images (as defined below) are intended solely to provide a photographic representation of a Listing at the time the photo was taken and do not constitute an endorsement by Sacoddo of any Host or Listing.
2. Conditions of Access and Use of the Platform
2.1 The platform is exclusively reserved for individuals aged 18 or older, as well as businesses, organizations, or other legal entities that are duly established, recognized, and compliant with applicable laws. Any access that does not comply with these conditions is strictly prohibited.
2.2 To access and use certain features of the Sacoddo Platform, such as publishing a Listing or making a booking, you must create an account (the “Sacoddo Account”). If you create a Sacoddo Account on behalf of a business, organization, or other legal entity, you certify that you have the authority to legally bind that entity and to grant us all permissions and licenses provided for in these Terms.
2.3 You can create an account by selecting an email address and password or by using your account with certain third-party social networking services, such as Facebook or Google.
2.4 It is essential to provide accurate, up-to-date, and complete information during the registration process and to keep your Sacoddo Account details and public profile information updated. You are fully responsible for any false or misleading information.
2.5 Creating multiple Sacoddo Accounts is prohibited unless authorized by Sacoddo. You are also not allowed to transfer or assign your Sacoddo Account to any third party in any manner.
2.6 You are solely responsible for maintaining the confidentiality and security of your Sacoddo Account credentials, and you are prohibited from sharing them with any third party. If you believe or suspect that your credentials have been lost, stolen, misused, or otherwise compromised, or if there is any actual or suspected unauthorized use of your Sacoddo Account, you must immediately notify the platform. You are responsible for all activities conducted through your Sacoddo Account unless you did not authorize such activities and were not otherwise negligent (for example, by failing to report unauthorized use of your account or the loss of your credentials).
2.7 For transparency and fraud prevention purposes, we may, but are not obligated to, request Members to provide official identification or other information or to undergo additional verification checks to confirm their identities and backgrounds.
2.8 A Member may terminate their registration at any time by sending an email to the platform’s designated email address or by calling the phone numbers listed on the platform’s contact page. However, if a reservation is in progress at the time of termination, the Member will remain bound by these Terms of Use for the entire duration of the reservation. The platform may also terminate a Member’s account at any time without prior notice if the Member fails to comply with the essential terms of these Terms of Use.
2.9 Sacoddo disclaims all liability in the event of non-compliance with the conditions of access and use.
3. Service Fees
3.1 Booking services for accommodations or other offerings are completely free for travelers. Our listing management fees are solely the responsibility of the host:
- 10 % de commission on an accommodation booking.
- 5 % de commission on an activity booking.
3.2 To secure an accommodation booking, you must pay a deposit equivalent to the price of one night's stay. If the booking is for a single night, the deposit will be equal to that night's price. For an experience booking, the required deposit is 50% of the total reservation amount. The deposit must be paid within the deadline set by the host, using a CIB or El Dahabia card. Once the deposit is paid, your booking is fully confirmed, and an invoice will be sent to both you and your host via email. On the day of check-in or the experience, you must pay the remaining balance in cash (as indicated in your invoice) directly to your host.
3.3 Sacoddo reserves the right to modify the service fees at any time and will inform Members within a reasonable timeframe before the new rates take effect. These fee changes will not apply to reservations made before the effective date of the modification.
3.4 Verified Listing :
For verified listings, we will visit the rental location to confirm that all the information provided in the listing is accurate.
This process serves as a rental verification service, helping to build trust and promote a culture of transparency and best practices.
The verification is valid for a maximum of nine months. After this period, it will no longer be valid, and a new verification will be required (free of charge).
Additionally, travelers themselves will contribute to the verification process by providing ratings and reviews after their stay.
4. Listing Publication Conditions :
4.1 Conditions Applicable to All Listings
When you create a Listing on the Sacoddo Platform, you must provide complete and accurate information about your Host Service (such as the description of the accommodation, its location, and availability dates), specify any deficiencies, restrictions (such as house rules), and applicable conditions (such as minimum age, skills, or physical condition required for an activity), and provide other relevant information requested by Sacoddo. It is your responsibility to keep your Listing information up to date (including availability dates).
You are solely responsible for setting the price for your Listing ("Displayed Price"). Once a Traveler has made a reservation, you may not request a higher price than the one stated in the booking request. In such a case, the platform reserves the right to permanently close your account.
The photos, animations, or videos used in your Listings must accurately reflect the quality and condition of your Host Services. Sacoddo reserves the right to require a minimum number of images, in a specific format, size, and resolution, for each Listing.
The insertion and ranking of Listings in search results on the Sacoddo Platform depend on various factors, such as the Traveler's search parameters and preferences, the Host's requirements, pricing and availability dates, the number and quality of images, customer service and cancellation history, Reviews and Ratings, the type of Host Service, and/or the response rate to booking requests.
When you accept or pre-approve a Traveler's booking request, you enter into a legally binding agreement with that Traveler and are then obligated to provide the Host Services as described in your Listing on the date of the booking request.
4.2 Listings for Accommodations
Hosts must be informed about and comply with the accommodation laws in our country, as well as any other laws directly or indirectly related to our services before using our platform. In the event that these laws are circumvented by a tenant, the platform disclaims all responsibility and will remove the listings as soon as it is informed.
Any Listing you publish, as well as the reservation of an Accommodation or a Traveler’s stay in the Accommodation, must not violate any agreements you have made with third parties. It must comply with all applicable laws (such as zoning laws), tax obligations, and other rules and regulations (including obtaining all required permits, licenses, and registrations).
The Host may only offer one Accommodation per Listing.
If you choose to require a security deposit of a specific value for your Accommodation, you must mention it in your Listing. Hosts are prohibited from requesting a security deposit after confirming a reservation or outside the Sacoddo Platform.
The Host has the right to request proof of the Travelers' family relationship (family record book), as well as documents proving the Travelers' identities. In case of refusal or failure to provide this proof, the stay may be canceled.
The Host may define house rules, such as a no-smoking policy, pet restrictions, etc., which will be displayed on the listing. Any booking request made by Travelers will be considered an explicit acceptance of these rules, and Travelers must familiarize themselves with and strictly adhere to them.
4.3 Listings for Activities
Hosts who post Listings for activities and events other than Accommodation agree to and comply with these terms.
Anyone who launches an activity or event on Sacoddo must have a high level of expertise in their field and excellent interpersonal skills with travelers.
To offer an activity or event, you must create a Listing. After publication, the activity or event may be removed due to the deletion provisions mentioned below or for any other reason stated in the Sacoddo Terms of Use.
All activities and events, as well as the hosts who offer them, must meet the following requirements :
-
Accuracy :
Hosts must describe their activity in a complete and precise manner, including the date and time, itinerary, meeting point, and the items provided to travelers. -
Commitment to Reservations :
Hosts must honor all their reservations, even if they involve only a small number of participants, except in the case of cancellation due to force majeure. -
Actively Hosted Experiences :
Hosts must personally guide their travelers throughout the activity. -
Minimum traveler rating, reviews, and commitment. :
Activities that have received too many negative reviews from participants may be removed.
Sacoddo reserves the right to remove activities or events that do not meet any of the above criteria.
When preparing an activity listing, hosts must fully inform travelers, when applicable, of the participation conditions, such as minimum age, required skills, activity level, or other requirements, as well as any inherent risks of the activity. They must also provide any other necessary information for safe participation in the experience or event (dress codes, equipment, special certifications or permits, etc.).
If you wish to offer an activity on behalf of a nonprofit organization or association ("social impact activity"), you must meet the following requirements to propose such an activity. When preparing a listing for a social impact activity, you affirm and guarantee that you are legally authorized to act on behalf of your nonprofit organization and acknowledge and agree that all payments will be deposited into an account held by your nonprofit organization. You and your nonprofit organization acknowledge that the listing of a social impact activity does not constitute a commercial fundraising event and that Sacoddo is neither a professional fundraiser nor a financial sponsor. It is the responsibility of nonprofit organizations to specify what portion of their listed price, if any, constitutes a charitable donation. You and your nonprofit organization are solely responsible for complying with all applicable laws related to your organization and the social impact activity.
The publication of nonprofit listings is free on Sacoddo.
Hosts take full responsibility for the activities they submit, offer, and provide. Sacoddo is merely a matchmaking platform and is not an operator, organizer, or owner of tours, activities, travel services, experiences, or events. It does not sell, provide, manage, or control them. Sacoddo's responsibility is limited to publishing listings on its platform and nothing more.
Hosts are responsible for acquiring all necessary equipment to offer an activity. You acknowledge that you assume full responsibility for ensuring that the equipment used in your activity is in good condition and complies with all applicable laws. Subject to any legal requirements to the contrary, you assume all risks of damage or accidents.
You are responsible for informing yourself about all laws and regulations that may apply to your activity and for complying with them, as well as obtaining the necessary licenses, permits, or approvals before offering an activity.
5. Special Conditions for Travelers :
5.1 Conditions Applicable to All Reservations
Subject to compliance with all conditions defined by Sacoddo, the traveler may book an Accommodation offered on the Sacoddo Platform by following the booking procedure described above. All applicable fees, including the Listed Price and the security deposit (if applicable), will be indicated in the listing before booking.
Upon receiving a booking confirmation from Sacoddo, a legally binding agreement is established between you and your Host.
If you are booking a Host Service on behalf of additional travelers, you must ensure that each of them accepts and complies with the conditions and rules set by the Host, as well as these Terms of Use of the platform. If you make a reservation for an additional traveler who is a minor, you certify that you are duly authorized to act on their behalf. Minors must be accompanied by a responsible adult to participate in an activity or other Host Service.
5.2 Accommodation Booking
The traveler agrees that a confirmed booking of an Accommodation constitutes a limited permission granted by the Host to occupy and enjoy the Accommodation for the duration of their stay.
The traveler commits to vacating the Accommodation no later than the check-out time specified by the Host in the Listing or at another time mutually agreed upon between the traveler and the Host. If the traveler fails to comply with the check-out time, the Host has the right to have them leave the Accommodation by lawful means.
5.3 Activity Booking
Travelers must carefully read the description of any activity they plan to book to ensure they meet the conditions and rules set by the Host in the Listing (including for other travelers they are booking for), such as minimum age, skills, physical condition, etc. At their discretion, travelers may choose to inform the Host of any health issues or other circumstances that might prevent them from safely participating in an Experience or Event.
Travelers must always follow the Host's instructions before and during the activity.
6. Booking Modifications, Cancellations, and Refunds :
Hosts and Travelers may cancel or modify a confirmed booking at any time (subject to applicable conditions). Hosts and Travelers are responsible for any cancellations or modifications they make on the Sacoddo platform or request via Customer Support.
If a Traveler requests a booking modification, the Host will be directly informed. The Host has the choice to accept or decline the modification.
If a Traveler cancels their booking, the refund policy specified in the listing will apply. If the cancellation occurs within the designated period, the full deposit will be refunded to the Traveler, minus a banking transaction fee of 250 DA. The platform will attempt to find another Traveler to replace the canceled booking for the same dates as quickly as possible.
If a Host cancels a confirmed booking, the deposit will be fully refunded to the Traveler. The platform will attempt to find an alternative booking to replace the canceled one. Sacoddo may publish a notice indicating that the listing was canceled by the Host and is unavailable.
If the platform determines that a Host or Traveler is not complying with stay conditions, Sacoddo may, at its sole discretion, cancel a confirmed booking and issue appropriate refunds.
If weather conditions pose a risk to Traveler safety or prevent a Host from conducting an outdoor experience or event, the Host may cancel the service. Hosts may also cancel if other conditions prevent them from offering the service safely.
For Activities, the following situations may qualify for a refund for Travelers, and Sacoddo may, at its discretion, reimburse Travelers for the full amount of fees they have paid for experiences in accordance with this policy:
- The host does not conduct the booked experience or arrives more than 90 minutes after the scheduled start time, causing the traveler to forgo participation.
- The host makes significant changes to the experience after booking that do not meet the travelers' expectations.
- The experience presents an apparent risk to safety or health that could reasonably hinder the traveler’s participation.
7. Ratings and Reviews :
After completing a reservation, travelers and hosts can leave a public review and a star rating (Rating) about their experience. The Ratings and Reviews reflect the opinions of the members and not those of the platform. They are not verified and may be unfounded or misleading.
Travelers and hosts are fully responsible for their reviews, which must be fair and accurate. They must not include offensive or defamatory language.
Ratings and Reviews are part of a member’s public profile and may also appear elsewhere on the Sacoddo platform (including on listing pages) along with other relevant information, such as the number of reservations, cancellations, average response time, and other details.
8. Damages and Compensation :
In accordance with the law, you are required to have an insurance policy covering risks such as fire, theft, and civil liability. Sacoddo strongly recommends that each host obtain insurance to cover any potential issues that may arise during travelers' stays.
As a traveler, you must return the accommodation (including all items within it) in the same condition as when you arrived. You are responsible for your own actions and those of any person you invite into the accommodation or grant access to.
If the host reports missing or damaged property at the end of the reservation, the traveler is required to compensate the host on-site. Consequently, the traveler will then be able to recover their deposit in full.
9. Content Policy :
By posting content on Sacoddo, you agree to comply with our content policy rules. We reserve the right to remove, in whole or in part, any content that does not adhere to these rules.
In cases of repeated or serious violations of the content policy, we reserve the right to suspend or permanently delete the account(s) in question.
Sacoddo allows members to create, upload, publish, or store content such as text, photos, audio or video content, and other materials and information on or through the Sacoddo platform ("Member Content"). Members may also access and view Member Content as well as any content provided by Sacoddo, including Sacoddo's proprietary content, licensed content, or content authorized by third parties ("Sacoddo Content").
Sacoddo may require hosts to use professional photographers to capture images of their services for inclusion in their listings, with or without a watermark or branding. If you stop providing your hosting service or if your Sacoddo account is closed or suspended for any reason, you acknowledge and agree that Sacoddo has the right to use these images to support and/or promote the platform while respecting copyright and intellectual property rights.
Members are solely responsible for all content they provide on or through the Sacoddo platform. They declare and certify that they are either the sole and exclusive owners of all content they share on Sacoddo or that their content complies with copyright, intellectual property laws, and all other applicable laws and regulations.
Sacoddo does not allow members to upload or publish any of the following types of content:
- Fraudulent, false, misleading, or deceptive content.
- Defamatory, profane, obscene, or vulgar content.
- Content that incites discrimination, bigotry, racism, hatred, harassment, or harm against an individual or community.
- Content that promotes or encourages illegal activities or the use of illegal or dangerous substances.
- Advertisements, promotional content, company logos, links, or commercial names.
- Illegal content that infringes upon the rights of a third party or entity, including intellectual property rights and privacy rights.
- Spam, repetitive, or disruptive content.
- Any content that violates Sacoddo’s Content Policy.
Sacoddo reserves the right to remove or disable access to any Content that violates these Terms or Sacoddo’s applicable Policies, or that may be potentially harmful to Sacoddo, its Members, or third parties. When Sacoddo removes or disables a Member's Content, Sacoddo will notify the Member and provide justification for this decision, unless such notification would prevent or hinder the detection of fraud or other illegal activity, or harm the legitimate interests of other Members or third parties.
You acknowledge that Sacoddo is not obligated to review Member Content or investigate facts and circumstances indicating illegal activity. However, Sacoddo has the right to investigate, verify, modify Member Content, or disable access in order to protect and enhance the security of the Platform or for other purposes outlined in these Terms. Members are encouraged to cooperate with Sacoddo in good faith, provide necessary information, and take reasonable measures required by Sacoddo in cases of misuse of the Platform.
Reporting content that violates Sacoddo's policy is essential to ensuring the quality and security of the platform. By flagging any inappropriate or rule-breaking content, users actively contribute to maintaining a respectful and safe environment for everyone. This collaboration enables the Sacoddo team to quickly identify and address violations, enhancing the overall user experience and the reliability of the services offered. User feedback, through reporting, is therefore a valuable component of the platform’s operation, allowing for the implementation of more precise adjustments and controls to ensure a digital space that meets everyone’s expectations.
10. Responsibility and Security :
The user acknowledges that the services offered may be interrupted due to internet outages or telecommunications infrastructure failures beyond our control, which may lead to temporary inaccessibility of the platform. Sacoddo may, on a temporary basis and while considering the interests of its Members, limit platform availability for maintenance or updates to ensure proper functionality and platform improvement. Sacoddo reserves the right to enhance, modify, or add new services and features at any time. Members will be informed of significant changes to the platform, except for minor modifications that do not materially affect the contractual obligations of the parties.
Sacoddo shall not be held liable in the event of a malicious intrusion. The user acknowledges that the services may contain technical or editorial errors that could, in some cases, lead to a loss of performance.
11. Personal Data Protection :
The Sacoddo platform is committed to strictly complying with the provisions of Law 18-07 on the protection of personal data. This law establishes strict rules regarding the collection, processing, and retention of personal information, aiming to safeguard individuals' rights and privacy. In accordance with these requirements, Sacoddo ensures that only the necessary data for service improvement is collected and that it is processed transparently and securely. Users of the platform are informed of their rights to access, rectify, and delete their data, in compliance with current regulations. Advanced security measures are also implemented to ensure the integrity of personal information against risks such as loss, theft, or unauthorized disclosure, thereby guaranteeing the platform’s compliance with national data protection standards.
