Sacoddo Platform General Terms of Use

Preamble

Welcome to the Sacoddo platform, accessible via our website and our mobile applications available on the Google Play Store and Apple App Store. By using the platform, you acknowledge that you accept these General Terms of Use. If you do not agree with these general terms, you may not use our platform.

The platform reserves the right to modify these General Terms of Use at any time. Changes will be effective as soon as they are posted online. If we modify these Terms, we will post the modified Terms on the Sacoddo Platform and update the "Last Updated" date at the top of the Terms. Please check these General Terms of Use regularly to stay informed of any updates. If you continue to access or use the Sacoddo Platform after the changes have been published, you will be deemed to have accepted the modified Terms.

A limited, revocable, and non-exclusive license is granted to users to access the Site, the Applications, and the content and services provided therein, in compliance with these General Terms. Any use of the Site or the Applications that does not comply with these General Terms or that is not authorized by us in writing is explicitly prohibited.

1. About Sacoddo Services

1.1 The Sacoddo Platform is an online service that allows users with an account (Members) and third parties or Members who offer services (Hosts) to publish these services (Host Services) on the Sacoddo Platform in the form of listings (Listings) and to communicate and deal directly with Members who wish to book these Host Services (Travelers). Host Services may include short-term rental of accommodation for holidays or other use (Accommodations), activities over one or more days in different categories, or access to unique events and venues (Activities).

1.2 The Sacoddo platform is in no way linked to travel services or other regulated activities. The Sacoddo Platform does not own, create, sell, resell, provide, control, manage, or offer any Listings or Host Services. Sacoddo is also not a package travel organizer or retailer, and Hosts are solely responsible for their Listings and Host Services. When Members make or accept a booking, they enter into a contract directly between themselves. Sacoddo is not and does not become a party to any contract entered into between Members, and Sacoddo is neither a real estate broker nor an insurer. Sacoddo does not act as an agent for any Member, except for the facilitation of the payment procedure described below.

1.3 Publications posted online by users are not monitored a priori by the platform. Each user assumes full responsibility for their publications and their commitments.

1.4 While Sacoddo may facilitate the resolution of disputes, Sacoddo does not control or guarantee (a) the existence, quality, safety, suitability, or legality of the Listings or Host Services, (b) the truthfulness or accuracy of the descriptions of the Listings, Ratings, Reviews, or other Member Content, or (c) the performance or conduct of any Member or third party. Sacoddo does not endorse any Member, Listing, or Host Service. All references to a "verified" Member (or any similar term) only mean that the Member has undergone an appropriate verification or identification procedure, and nothing else. Such a description constitutes neither an endorsement, nor a certification, nor a guarantee on the part of Sacoddo regarding a Member, including their identity, background, reliability, or character. You should always be cautious when deciding to stay in an Accommodation, participate in an activity or an Event, or use other Host Services, to accept a booking request from a Traveler, or to have any other exchange or interaction with any other Member, online or in person. Verified Images are intended only to provide a photographic representation of a Listing at the date the photograph was taken, and therefore do not constitute an endorsement by Sacoddo of any Host or any Listing.

2. Conditions for Access and Use of the Platform

2.1 The platform is reserved exclusively for natural persons aged 18 or older, companies, organizations, or other legal entities duly constituted, recognized, and in good standing under the laws in force. Any access or use not in compliance with these conditions is strictly prohibited.

2.2 In order to access certain features of the Sacoddo Platform and use them, such as publishing a Listing or making a booking, you must create an account (the "Sacoddo Account"). If you create a Sacoddo Account for a company, organization, or other legal entity, you certify that you have the authority to legally bind that legal entity and to grant us all the authorizations and licenses provided for in these Terms.

2.3 You can create an account by providing your phone number (validated by SMS OTP), or by choosing an email address and a password, or by using your account with certain third-party social network services, such as Facebook or Google.

2.4 It is essential to enter accurate, up-to-date, and complete information during the registration process and to keep the information in your Sacoddo Account and on your public Sacoddo profile page up to date. You assume all responsibility in the event of providing false information.

2.5 It is prohibited to create multiple Sacoddo Accounts unless Sacoddo expressly authorizes you to do so. It is prohibited to assign or transfer your Sacoddo Account in any way to a third party.

2.6 It is your full responsibility to maintain the confidentiality and security of your Sacoddo Account credentials, and you are prohibited from disclosing your account credentials to a third party. If you believe or suspect that your credentials have been lost, stolen, misappropriated, or compromised in any way, or in the event of actual or suspected unauthorized use of your Sacoddo Account, you must immediately inform the platform. You are responsible for all activities conducted with your Sacoddo Account, unless you have not authorized these activities and you have not otherwise demonstrated negligence (for example, by not reporting the unauthorized use of your account or the loss of your credentials).

2.7 For the purposes of transparency and fraud prevention, we may, without being required to do so, ask members to provide us with an official piece of identification or other information, or to submit to other checks intended to verify the identities and backgrounds of the Members.

2.8 End of Registration and User Autonomy

A Member may terminate their registration at any time. To do so, they have two options directly accessible via the application or the site:

  1. Temporary Suspension: The Member may temporarily suspend their account. This action hides their profile and listings but retains their data for future reactivation.
  2. Definitive Deletion: The Member may initiate the definitive deletion of their account. This action leads to the irreversible deletion of their personal data (name, telephone, address, documents).

However, if a Member has an ongoing reservation (Host or Traveler), definitive deletion cannot be finalized until the service is fully completed and any financial or transactional obligations are resolved. The Member will remain bound by these general terms of use during this period.

The Platform may also terminate the registration at any time, without notice, if the member does not respect the essential terms of these GTU.

2.9 Sacoddo disclaims all liability in the event of negligence by users regarding the conditions of access and use.

3. Service Fees and Payment Terms

3.1 In consideration for the use of the Sacoddo Platform, service fees and commissions are applied as follows:

  • Host Commission (Accommodations and Activities): A 5% commission is deducted by Sacoddo from the total amount of all bookings (Accommodations and Activities). This commission is deducted from the deposit collected online.
  • Traveler Service Fees (Accommodations only): A service fee of 5% is added to the total amount of the booking exclusively for the booking of Accommodation. These fees are paid by the Traveler at the time of the online deposit payment. Booking activities via the platform is free for the Traveler (no additional service fees).

3.2 Booking and Payment Procedures: To confirm a booking, the Traveler must make an online payment via the Sacoddo Platform.

  • For an Accommodation: The Traveler must pay a deposit online corresponding to the price of the first night to confirm the booking.
  • For an Activity: The Traveler must pay the full amount of the booking online at the time of confirmation.
  • Online Payment Methods: Payment is made online within the timeframes set by the Host, either by CIB/El Dahabia card (in DZD), or by international bank card via the secure Stripe gateway (in converted foreign currencies).
  • Confirmation: Once the online payment is made, the booking is definitively confirmed. An invoice is sent to the Host and the Traveler by email.

3.3 Settlement of the Balance and Payment to the Host

  • Settlement of the Balance (Accommodation only): On the day of arrival (on-site visit), the Traveler must hand over the remaining balance due in cash (as indicated on the invoice) directly to their Host.
  • Transfer of Funds to the Host: The amounts collected online by Sacoddo (deposit for Accommodation or the total for the Activity), after deduction of the applicable commissions and service fees according to point 3.1, will be paid to the Host. This payment will be made within a maximum of 7 working days after the actual completion of the service, according to the banking methods chosen by the Host.

3.4 Sacoddo reserves the right to modify the Service Fees at any time and will inform Members within a reasonable period before the new rates take effect. These modifications will not affect bookings made before the effective date of the modification.

3.5 Verified Listing: In the case of a verified listing, we proceed with an online verification of the information provided on the listing to ensure its authenticity. This procedure aims to promote trust and transparency. Furthermore, the rating and review system allows Travelers to participate in the continuous verification of services.

4. Conditions for Publishing Listings

4.1 Conditions applicable to all Listings

When you create a Listing on the Sacoddo Platform, you must provide complete and accurate information about your Host Service (such as the description of the accommodation, its location, and availability dates), specify deficiencies, restrictions (such as house rules), and applicable conditions (such as minimum age, skills, or physical condition required for an activity), and provide other useful information requested by Sacoddo. You are responsible for keeping your Listing information up to date (including availability dates).

You are solely responsible for setting the price for your Listing ("Displayed Price"). Once a Traveler has booked, you cannot ask them for a price higher than the one appearing in the booking request. In such a case, the platform reserves the right to permanently close your account.

The photos, animations, or videos used in your Listings must faithfully reflect the quality and condition of your Host Services. Sacoddo reserves the right to impose a minimum number of Images, in a specific format, size, and resolution, for each Listing.

The placement and ranking of Listings in search results on the Sacoddo Platform depend on various factors, such as the Traveler's search parameters and preferences, the Host's requirements, prices and availability dates, the number and quality of Images, customer service and cancellation history, Reviews and Ratings, the type of Host Service, and/or the response rate to booking requests.

When you accept or have pre-approved a booking request from a Traveler, you enter into a legally binding agreement with that Traveler, and you are then required to provide the Host Service(s) to the Traveler in the manner described in your Listing at the date of the booking request.

4.2 Listings for Accommodations

Hosts must inform themselves and comply with the laws in force regarding accommodation in our country, as well as other laws directly or indirectly related to our services before using our platform. In the event that these laws are bypassed by a tenant, the platform disclaims all responsibility and will delete the listings as soon as it is informed.

Any Listing you publish and the booking of an Accommodation or the stay of a Traveler in the Accommodation will not violate any agreement you have entered into with third parties, will comply with all applicable laws (such as urban planning laws), tax obligations, and other rules and regulations (including obtaining all required permits, licenses, and registrations).

The Host can only offer one Accommodation per Listing.

If you choose to request a security deposit of a specific value for your Accommodation, you must mention it in your Listing. Hosts are prohibited from requesting a security deposit after confirming a booking, or outside the Sacoddo Platform.

The Host has the right to request proof of relationship of the Travelers (family book), as well as documents proving the identities of the Travelers. In case of refusal or failure to present this proof by the travelers, the stay may be cancelled.

The Host may describe house rules such as a ban on smoking, pets, etc., which will be displayed on the listing. Any booking request for the accommodation by travelers will be considered as explicit acceptance of these rules, and Travelers must inform themselves of the house rules and respect them scrupulously.

4.3 Listings for Activities

Hosts who publish Listings for activities and events other than Accommodation accept and comply with these conditions.

Anyone who launches an activity or an event on Sacoddo must possess a high level of expertise in their field and an excellent sense of contact with travelers.

To propose an activity or an event, you must create a Listing. After publication, the activity or event may be deleted due to the deletion provisions mentioned below, or due to any other provision appearing in the Sacoddo Terms of Use.

All activities and events, as well as the hosts who propose them, must meet the following requirements:

  • Accuracy: hosts must describe their activity in a full and accurate manner, including especially the date and time, the itinerary, the meeting place, as well as the items provided to the travelers.
  • Commitment to bookings: hosts must honor all their bookings, even if they only concern a small number of participants, except in the case of cancellation following a case of force majeure.
  • Actively led experiences: hosts must personally guide their travelers throughout an activity.
  • Minimum traveler evaluation, ratings, and engagement: activities that have received too many negative reviews from participants may be deleted.

Sacoddo reserves the right to delete activities or events that do not meet any of the above criteria.

When preparing a listing regarding an activity, hosts must, if applicable, fully inform Travelers of the conditions of participation, such as minimum age, required skills, level of activity or other requirements, as well as the risks inherent in any activity, and inform them of any other information necessary to participate safely in this Experience or event (dress codes, equipment, special certifications or permits, etc.).

If you wish to propose an activity on behalf of a non-profit organization or association ("social impact activity"), you must meet the requirements below to propose a social impact activity.

When preparing a listing regarding a social impact activity, you affirm and guarantee that you are legally authorized to act on behalf of your non-profit organization and acknowledge and agree that all payments will be paid into an account held by your non-profit organization.

You and your non-profit organization acknowledge that the listing regarding a social impact activity does not create a commercial fundraiser and that Sacoddo is not a professional fundraiser or a funder.

It is up to non-profit organizations to specify what portion of their Displayed Price, if any, constitutes a charitable donation.

You and your non-profit organization are solely responsible for compliance with all laws applicable to your organization and to the social impact activity.

The publication of non-profit listings is free on Sacoddo.

Hosts take full responsibility for the activities they submit, propose, and provide. Sacoddo is only a linking platform and is not an operator, organizer, or owner of tours, activities, travel services, Experiences, or Events and it does not sell, provide, manage, or control them.

The responsibility of Sacoddo is limited to the publication, on its platform, of listings and nothing else.

Hosts are responsible for the acquisition of all Equipment necessary to propose an activity. You agree to assume full responsibility for ensuring that the Equipment used in your activity is in good condition and complies with all laws in force. Subject to contrary legal requirements, you assume all risk of damage or accidents.

You are responsible for informing yourself about all laws and regulations that may apply to your activity and for complying with them to obtain the necessary licenses, permits, or approvals before proposing an activity.

5. Special Conditions for Travelers

5.1 Conditions applicable to all bookings

The Traveler can book a Host Service by following the booking procedure described above. All applicable fees, including the Displayed Price, will be indicated to them before the booking. Upon receipt of the confirmation, a legally binding agreement is established with the Host. To book for additional travelers, you must verify that they accept and respect the conditions defined by the Host and these GTU. For minors, you certify that you are duly authorized to act on their behalf. They must be accompanied by a responsible adult.

5.2 Booking of Accommodations

A confirmed booking constitutes a limited permission granted by the Host to occupy the Accommodation for the duration of the stay. The Traveler agrees to leave the Accommodation no later than the indicated check-out time. In case of overstaying, the Host is entitled to make the Traveler leave the Accommodation by means compliant with the law.

5.3 Booking of Activities

Travelers must carefully read the description to verify that they meet the conditions (age, physical condition). They must follow the Host's instructions before and during the activity.

6. Booking Modifications, Cancellations, and Refunds

Hosts and Travelers are responsible for cancellations or modifications made on the Sacoddo Platform. The Host has the choice to accept or refuse a modification request from the Traveler. In the event of cancellation by the Traveler, they are subject to the refund conditions specified in the listing. If the cancellation occurs within the determined period, the full payment made online will be refunded, after deduction of bank transaction fees. The platform undertakes to search for another traveler for the same dates.

If a Host cancels a confirmed booking, the payment made online will be fully refunded to the Traveler. The platform undertakes to try to find a replacement booking. Sacoddo may publish a comment indicating the cancellation by the Host.

Sacoddo may, at its discretion, cancel a confirmed booking and make the appropriate refunds if a member does not respect the conditions.

For activities, Hosts can cancel in case of dangerous weather conditions or if other conditions prevent the service from being offered safely.

A full refund for activities can be made if:

  • The Host does not perform the experience or arrives more than 90 minutes late.
  • The Host makes significant changes after the booking without the Traveler's agreement.
  • The experience presents an apparent risk to safety or health.

7. Ratings and Reviews

After a booking, Travelers and Hosts can leave a public review and a rating (stars). They reflect the opinion of the members and not that of Sacoddo, and are not verified a priori. They must be fair, truthful, and not include insulting or defamatory terms. They are part of the public profile.

8. Damage and Compensation

Sacoddo strongly recommends that each Host take out insurance suitable for their rental or animation activity covering their civil liability.

As a Traveler, you are required to return the Accommodation (and the property therein) or the activity equipment in the state in which you found it upon your arrival. You are responsible for your own actions and those of anyone you invite. In the event of proven damage noted at the end of the service, the Traveler is required to compensate the Host directly on site.

9. Content Policy

By publishing content on Sacoddo, you agree to comply with the rules of our content policy. We reserve the right to remove, in part or in full, any content that does not comply with these rules.

In the event of repeated and serious violations of the content policy, we reserve the right to suspend or permanently delete the account(s) in question.

Sacoddo may authorize Members to create, upload, publish, or store content, such as text, photos, audio or video content, or other documents and information on or through the Sacoddo Platform (Member Content), and to access and view the Member Content and any content made available by Sacoddo on or via the Platform, including Sacoddo's proprietary content and any content under license or that a third party has authorized Sacoddo to use (Sacoddo Content).

Sacoddo may ask Hosts to use professional photographers to take images or shots of their proposed services so that they insert them in their Listings with or without a watermark or marking. If you stop providing the Host Service, or if your Sacoddo Account is closed or suspended for any reason, you acknowledge and agree that Sacoddo has the right to use any image to feed and/or promote the Platform in compliance with copyright and intellectual property rights.

Members are solely responsible for all the content they make available on or via the Sacoddo Platform. Consequently, they declare and certify that they are either the sole and exclusive owners of all the Content they make available on or via the Sacoddo Platform, or that they comply with copyright and intellectual property laws or any other applicable law or regulation.

Sacoddo does not authorize the uploading or publishing of any of the following Member Content:

  • Fraudulent, false, misleading, or untruthful.
  • Defamatory, profane, obscene, or vulgar.
  • Incites discrimination, fanaticism, racism, hatred, harassment, or causes harm against an individual or a community.
  • Endorses or encourages illegal activities or the use of illegal or dangerous substances.
  • Advertising or other content for commercial purposes, logos, links, or company names.
  • Illegal content that does not respect the rights of a third party or an entity, including intellectual property rights and privacy rights.
  • Spam and repeated and disturbing content.
  • Violates Sacoddo's Content Policy.

Sacoddo reserves the right to remove or disable access to any Content that goes against these Terms or Sacoddo's current Policies, or is potentially harmful to Sacoddo, its Members, or third parties. When Sacoddo removes or disables Member Content, Sacoddo sends a notification to the Member and gives them the justifications for this decision unless this notification prevents or hinders the discovery of fraud or another illegal activity, or harms the legitimate interest of other Members or third parties.

You agree that Sacoddo is not under the obligation to examine member content or to investigate facts and circumstances indicating illegal activity, but that Sacoddo has the right to investigate, verify, modify Member Content, or disable access in order to protect and improve the security of the Platform or for other purposes provided for in these Terms. Members are invited to collaborate with Sacoddo and to help it in good faith, to provide the necessary information, and to take the reasonable measures required by Sacoddo in the case of misuse of the Platform.

Reporting content that violates Sacoddo's policy is an essential means to ensure the quality and safety of the platform. By reporting any inappropriate content or content in violation of the rules, users actively contribute to maintaining a respectful and secure environment for everyone. This collaboration allows the Sacoddo team to identify and quickly address infractions, thereby improving the overall user experience and the reliability of the services offered. User feedback, through reports, is therefore a valuable component of the platform's operation, allowing for more precise adjustments and controls to be put in place to ensure a digital space that meets everyone's expectations.

9.1 Reporting and Blocking Mechanisms

As a platform relying on user-generated content (listings, photos, comments), Sacoddo is committed to providing a safe and respectful environment. To this end, the Platform provides the following mechanisms:

  1. Content Reporting: Any user can report a listing, comment, or profile they consider inappropriate or in violation of these Terms. Sacoddo promptly reviews all reports (within 24 hours).
  2. User Blocking: Any user has the ability to immediately block another user. Blocking prevents the blocked user from contacting the user who blocked them, seeing their listings, or sending them messages.
  3. Moderation Actions: Sacoddo reserves the right to remove any reported content that violates these Terms, and to suspend or permanently delete the account of any user who repeatedly or seriously violates the content policy.

It is the responsibility of each user to use the reporting and blocking mechanisms responsibly to help maintain the quality and safety of the Platform.

10. Liability and Security

The user acknowledges that the services offered may be interrupted in the event of breakdowns or cuts in the Internet or telecommunications infrastructures which are beyond our control and which can lead to interruptions in the accessibility of the platform. Sacoddo may, temporarily and taking into consideration the interests of the Members, limit the availability of the Platform for reasons of maintenance or updates in order to ensure the proper functioning or to improve the Platform. Sacoddo may improve or modify the Platform and add new Services or features at any time. Consequently, Sacoddo will inform Members of these modifications made on the platform, with the exception of minor modifications that do not have a material effect on the contractual obligations of the parties.

Sacoddo's liability shall not be engaged in the event of a malicious intrusion. The user acknowledges that the services may contain errors of a technical or editorial nature which may lead in certain cases to a loss of performance.

11. Protection of Personal Data

The Sacoddo platform undertakes to strictly respect the provisions of Law 18-07 on the protection of personal data. This law imposes strict rules concerning the collection, processing, and storage of personal information, with the aim of protecting the rights and privacy of individuals. In accordance with these requirements, Sacoddo ensures that it collects only the data necessary for the improvement of the service and processes it in a transparent and secure manner. Users of the platform are informed of their rights of access, rectification, and deletion of their data, in accordance with the regulations in force. Advanced security measures are also put in place to guarantee the integrity of personal information against any risk of loss, theft, or unauthorized disclosure, thus ensuring the platform's compliance with national standards for data protection.

12. Applicable Law

These general terms of use are governed and interpreted in accordance with Algerian law. Any dispute relating to their validity, interpretation, or execution will be submitted to the exclusive jurisdiction of the Algerian courts.
